1. Eligibility

You must be at least 13 years old to use FastTrak. By using the App, you represent that you meet this age requirement.

2. App Description

FastTrak is a fasting tracker that allows you to monitor fasting sessions, log weight, view estimated statistics, and optionally connect with Apple Health. The App offers both free features and a premium subscription (“FastTrak Plus”) that unlocks additional analytics.

3. Health Disclaimer

FastTrak is a wellness and lifestyle tool. It is NOT a medical device, and it does NOT provide medical advice, diagnosis, or treatment.

All statistics displayed in the App — including but not limited to estimated fat burned, energy used, glycogen depletion, water mass changes, and money saved — are approximate, model-based estimates. They are intended for informational and motivational purposes only.

You should consult a qualified healthcare professional before starting any fasting regimen, particularly if you have any medical conditions, are pregnant or nursing, or are taking medication.

We expressly disclaim any liability for health outcomes resulting from the use of this App. Use FastTrak at your own risk.

4. Subscriptions and Payments

• FastTrak Plus is available as an auto-renewing subscription (monthly or annual), purchased through Apple's In-App Purchase system.
• Payment is charged to your Apple ID account at confirmation of purchase.
• Your subscription automatically renews unless you turn off auto-renewal at least 24 hours before the end of the current billing period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period, at the cost of the chosen plan.
• You can manage or cancel your subscription at any time through your device's Settings > [Your Name] > Subscriptions, or through the App Store.
• If a free trial is offered, any unused portion of the free trial period will be forfeited when you purchase a subscription.
• Free trial eligibility, pricing, and terms are as displayed at the time of purchase and are subject to Apple's terms.
• We do not process payments directly. All billing is handled by Apple. Refund requests should be directed to Apple Support.

5. Intellectual Property

The App, its design, code, content, trademarks, and logos are the property of Bluebry Oy and are protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from any part of the App.

6. User Conduct

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble the App.
• Interfere with or disrupt the App's functionality.
• Misrepresent the App's outputs as medical advice to others.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, available at https://www.bluebry.com/fasttrak/privacy. By using the App, you acknowledge and agree to our data practices as described therein.

8. Apple Health Integration

If you choose to connect Apple Health, the App will access and/or write health data as described in our Privacy Policy. This integration is optional. HealthKit data is never used for advertising or marketing, in compliance with Apple's HealthKit guidelines.

9. Disclaimer of Warranties

The App is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• The results or estimates provided by the App will be accurate or reliable.
• Defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Bluebry Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App.

Our total liability for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for FastTrak Plus in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Bluebry Oy from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App or violation of these Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, for any reason, without prior notice. Upon termination, your right to use the App ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

13. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Finland.

Nothing in these Terms affects your statutory rights as a consumer under Finnish or European Union law.
